It’s been a wild week already. Non-payment eviction cases resumed in the courts, eviction protests broke out (kind of), at least one judge’s home was vandalized, and the Governor signed a new Executive Order on evictions. New KY Supreme Court Order - Nonpayment Evictions May Proceed on August 1

Well, the rental industry got an unexpected bit of good news today when the Kentucky Supreme Court issued a new order allowing all evictions to proceed as of August 1, under the following terms: All properties covered by the CARES Act must first issue a 30-day notice to vacate. If you’re not sure if your property is covered, make sure to read this post. Lawsuit against the Governor to Allow Evictions for Failure to Pay A few weeks ago I mentioned that a group was contemplating filing a lawsuit against the Governor if things did not open up soon. Here's a quick video on three things that landlords and property managers should know about Governor Beshear's latest Executive Order, which you can read in its entirety here. BUSINESS CLOSINGS All businesses that are not considered “Life Sustaining” must cease operations effective at 8:00 p.m. on Thursday, March 26, except as needed to conduct Minimum Basic Operations. As of now, it is my position that Property Management companies falls within the definition of a Life Sustaining Business. The language of the order defines a Life Sustaining Business to include those that “provide construction or maintenance of residential . . ....
